Just On Table

These terms govern your use of Just On Table — our website and both mobile applications. Please read them. By creating an account or using the service, you agree to them.
The short version. Just On Table is a platform that connects diners with restaurants. We handle discovery, bookings, ordering and payment. Restaurants — not us — prepare your food, and are responsible for it. If something is wrong with your meal, the restaurant is the party responsible, though we will help you reach them.
“Just On Table”, “we”, “us” and “our” mean [legal entity name], 9231 Long Point Rd, Houston, TX 77055, United States. “Platform” means our website and mobile applications. “Diner” means a person using the Just On Table app to book or order. “Restaurant” means a business using Just On Table Business to receive bookings and orders. “You” means whichever applies to you.
You must be at least 18 years old, or the age of majority where you live, to use Just On Table.
Just On Table is a marketplace and technology platform. We are not a restaurant, a food producer or a delivery company. When you book a table or place an order, the contract for that meal or reservation is between you and the restaurant. We facilitate it, take payment on the restaurant's behalf, and pass the order to them.
Restaurants are independent businesses. They set their own menus, prices, opening hours, service areas, preparation times and policies. We do not control how they prepare food, how quickly they serve, or how they treat guests, and we are not liable for their acts or omissions.
A booking request is not confirmed until the restaurant accepts it. You will be notified when it is accepted, and again if the restaurant is unable to honour it.
An order is an offer to buy. It becomes binding when the restaurant accepts it. A restaurant may decline an order — for example because an item is unavailable, it is outside their delivery area, or they are at capacity — and you will not be charged for a declined order.
Just On Table supports three service types:

Preparation and delivery times shown in the app are estimates given by the restaurant, not guarantees. Once a restaurant has begun preparing an order it may not be possible to change or cancel it.
If a restaurant cancels your order, or cannot fulfil it, you receive a full refund to your original payment method or wallet.
If you cancel before the restaurant begins preparing your order, you receive a full refund. Once preparation has begun, a cancellation may not be possible and a refund may not be available, because the food has already been made.
If your order arrives incorrect, incomplete or unacceptable, contact the restaurant through the app as soon as possible. If it cannot be resolved, contact us and we will help mediate. Refunds we agree are issued to your original payment method or as wallet credit. Refunds typically reach your card within [5–10 business days], depending on your bank.
Access to Just On Table Business requires an active subscription. Plans, prices and terms are shown in the app before you subscribe. Subscriptions run for the period of the plan chosen and [state renewal behaviour: automatic renewal, or manual]. If a subscription lapses, your listing may be hidden from diners until it is renewed.
You keep ownership of your menus, photos, logo and descriptions. You grant us a non-exclusive, worldwide, royalty-free licence to host, display, reproduce and adapt that content for the purpose of operating and promoting the platform and your listing. You confirm you have the rights to everything you upload.
You must not:
Allergen and ingredient information shown in the app is provided by the restaurant, not verified by us. Preparation environments may not be free of allergens, and cross-contamination is possible.
If you have a food allergy or intolerance, contact the restaurant directly before ordering. Do not rely solely on information displayed in the app. We accept no liability for allergen information supplied by a restaurant.
Restaurants are solely responsible for the safety, quality, preparation, labelling and accurate description of the food they sell, and for compliance with all food-safety law.
The Just On Table platform, name, logo, design and software are owned by us and protected by intellectual property law. We grant you a limited, personal, non-transferable, revocable licence to use the apps for their intended purpose. You may not copy, modify, distribute, sell or lease any part of the platform.
The platform is provided “as is” and “as available”. We do not warrant that it will be uninterrupted, error-free or secure, or that estimated times will be met. We do not endorse or guarantee any restaurant, its food, or its service.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or business opportunity, arising from your use of the platform.
To the fullest extent permitted by law, our total liability to you for any claim relating to the platform is limited to the greater of [amount, e.g. US$100] or the total amount you paid through Just On Table in the [three] months before the event giving rise to the claim.
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including for death or personal injury caused by negligence, or for fraud.
You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these terms, your misuse of the platform, or — if you are a restaurant — from the food and service you provide.
You may stop using Just On Table at any time and delete your account in the app or by emailing us. Deleting your account forfeits any remaining wallet balance and unredeemed cashback, so use them first.
We may suspend or terminate an account that breaches these terms, that we reasonably believe is being used fraudulently or unlawfully, or that presents a risk to other users or to the platform. Where practical and lawful, we will tell you why. Restaurants with outstanding obligations remain liable for them after termination.
These terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules. Any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Harris County, Texas, unless the law where you live requires otherwise. [If you want arbitration and a class-action waiver, they must be added here explicitly — have counsel draft them.]
We may update these terms as the service and the law change. We will update the “last updated” date and, for material changes, notify you in the app or by email before they take effect. Continuing to use Just On Table after a change means you accept the updated terms. If you do not accept them, stop using the platform and delete your account.
